How Selling an Inherited Car Works

1. Wait 40 days.

California law requires 40 days to pass from the date of death before a vehicle can be transferred without probate. Use that time to gather two things: a certified copy of the death certificate and the title. If the title is lost, a duplicate is a REG 227 and costs $28, and we can request it at the same time.

2. Complete the REG 5.

The REG 5 is the DMV's Affidavit for Transfer Without Probate. It is a one-page form where you certify that you are entitled to the vehicle and that the 40 days have passed. It is not difficult, but it can take some time to get right, especially while you are handling everything else an estate involves.

The honest limit

When Probate Is Required

Most families never need probate. The REG 5 path covers the majority of inherited cars. But there are three situations where the simple route does not apply and a quick phone call first is worth it:

  • •The estate is over the threshold. If the estate's non-vehicle assets exceed $208,850, the REG 5 affidavit will not work and the estate goes through probate. Vehicles themselves do not count toward that number.
  • •Heirs are disputing ownership. Everyone listed on the affidavit has to agree and sign. If the family cannot agree on who gets the car, that has to be sorted out before any transfer.
  • •The title is from another state. The REG 5 only covers California-titled vehicles. An out-of-state title has to be handled through that state first, then registered here.

Can I sell an inherited car before probate is finished?+
In most cases you never need probate at all. California lets you transfer a vehicle without probate using the REG 5 affidavit, as long as 40 days have passed since the death, the car is California-titled, and the estate's non-vehicle assets are under $208,850. Probate is only required for larger estates, disputed heirs, or an out-of-state title. What if there are multiple heirs?+
If everyone agrees, all heirs listed on the affidavit sign the REG 5 and we move forward. If heirs are disputing ownership and cannot agree, that is one of the situations where probate may be required, and it is worth a quick phone call first so we can figure out the right path before anyone signs anything.
What if the title is from another state?+
The REG 5 process only works for California-titled vehicles. An out-of-state title has to be handled through that state's process first. It does not mean we cannot do it, it just means the path is different, so give me a call and we will sort out the steps. I have worked through multi-state estate paperwork many times.
What if my spouse's name is also on the title?+
It depends on the word between the two names. If the title reads one name 'or' the other, ownership passes to you automatically and you do not need the REG 5. Just bring the title and the death certificate. If the title reads one name 'and' the other, you use the REG 5 process to remove the deceased person's name. A newer option is a Transfer on Death beneficiary, filed on a REG 256, which passes the car to the named person with no 40-day wait.
